Terms of Use

1. Acceptance of these terms

By creating an account or using TalkyForm in any way, you agree to these Terms of Use. If you are using TalkyForm on behalf of a company or other entity, you represent that you have the authority to bind that entity, and "you" refers to that entity.

2. The service

TalkyForm lets you add a conversational interface to forms on your own website. You install a script on pages you control and mark the form you want handled; TalkyForm interviews your visitors and fills that form on your visitor's behalf. TalkyForm does not receive or process your form submissions — your own site's existing submit handler still receives them, exactly as if the visitor had typed the answers themselves.

We may change, suspend, or discontinue any part of the service at any time, and we may impose limits on usage (for example, conversations per day) without notice.

3. Your account

You are responsible for the accuracy of the information you give us and for keeping your account credentials confidential. You are responsible for everything that happens under your account, whether or not you authorized it, except to the extent caused by our own breach of these terms.

4. Your forms and your visitors' data

You are solely responsible for the forms you connect to TalkyForm, for the lawfulness of collecting the information those forms ask for, and for obtaining any consent or notice your visitors are owed under applicable law — including, where relevant, laws governing health, financial, or other sensitive information. You represent that you have the right to have TalkyForm interview your visitors on your behalf for every form you connect.

Depending on the retention mode you choose for a given form, TalkyForm may temporarily process conversation content as part of running the interview, and may retain a transcript and structured answers for your own later reference. You are responsible for choosing the retention mode appropriate to the data your form collects.

5. Acceptable use

You agree not to, and not to allow anyone else to:

• Use TalkyForm for any unlawful purpose, or to collect information you are not lawfully entitled to collect;
• Probe, scan, or attempt to circumvent any rate limit, usage cap, or security control of the service;
• Reverse engineer, decompile, or attempt to extract the source code of the service, except where the law gives you that right despite this restriction;
• Resell, sublicense, or provide the service to third parties as your own product;
• Use the service to generate, request, or store content that is illegal, fraudulent, or infringes another party's rights; or
• Interfere with or disrupt the service, or the servers or networks that provide it, including through excessive automated requests.

We may suspend or terminate your account, without notice, if we reasonably believe you have violated this section.

6. Fees

Paid plans are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law. We may change our prices on notice; continued use of the service after a price change takes effect means you accept the new price.

7. Termination

You may stop using TalkyForm and delete your account at any time. We may suspend or terminate your access to the service at any time, for any reason, including non-payment or a violation of Section 5. On termination, your right to use the service ends immediately; sections of these terms that by their nature should survive termination will survive, including Sections 4, 8, 9, and 10.

8. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AI-GENERATED OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKYFORM AND FIRST MILLION PTE LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless TalkyForm, First Million Pte Ltd, and their officers and employees from any claim, loss, or damage, including reasonable legal fees, arising from your use of the service, the forms you connect to it, the data those forms collect, or your violation of these terms.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will post the updated terms on this page with a new "last updated" date. Continuing to use the service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Singapore, without regard to its conflict of law principles.
